The Little and Withlacoochee Rivers form the east boundary of Brooks County, and Piscola and Okapilco Creeks flow out of it into the Withlacoochee, all above the Floridan Aquifer.

RESOLUTION 26-R-01
A RESOLUTION ADOPTING A TEMPORARY MORATORIUM ON DATA CENTER FACILITIES IN BROOKS COUNTY TO PROMOTE PUBLIC HEALTH, SAFETY, AND WELFARE
WHEREAS, the Brooks County Board of Commissioners has the authority to exercise the legislative functions of the County, and may pass any resolution that it deems best for the government of the county so long as such resolution is not in conflict with state law, the state constitution, or the constitution or the laws of the United States;
WHEREAS, the Brooks County Board of Commissioners desires to impose a three (3) month moratorium on any data center facilities or operations to allow the Brooks County Board of Commissioners to conduct appropriate fact finding to ascertain the safety concerns of data centers and how to regulate the same.
NOW, THEREFORE BE IT RESOLVED by the Brooks County Board of Commissioners. that there now exists:
- A temporary three (3) month moratorium on data center facilities or operations in Brooks County, Georgia.
- This temporary moratorium shall be effective upon adoption of this Resolution and naturally expire May 2, 2026, unless properly extended prior to said date.
AND BE IT FURTHER RESOLVED that nothing in this Resolution shall be interpreted as waiving, or in contradiction of, any authority or power existing in or granted to the Brooks County Commission to institute such a moratorium at any time, or extend any such moratorium, to protect the health, safety, and welfare of Brooks County and its citizens, and that to the extent of such power, this moratorium shall be effective immediately.
