Sabal Trail through Lowndes past Clyattville Elementary School

The invading pipeline would pass within about one mile of Clyattville Elementary School Railroad Ave. to Clattville Elementary School where it would cross Clyatt Mill Creek and then Railroad Avenue, at about 30.680638, -83.326501.

This would be after crossing the Withlacoochee River from Brooks into Lowndes Counties just north of US 84, and before crossing Jumping Gulley Creek and the state line into Hamilton County Florida, where the hearing was held in Jennings for WWALS v. Sabal Trail & FDEP.

You can see the general route in the Cover Map. After crossing the Withlacoochee River, Sabal Trail would cross Martin Lane and Tiger Creek, then Continue reading

EPA letter could change pipeline path –Jasper News

Sabal Trail won’t comment in Florida about the EPA letter to FERC that validates what WWALS and many others have been saying, although Sabal Trail did comment in Georgia.

Front page top Carl McKinney, Jasper News, 5 November 2015, front page, apparently not online, EPA letter could change course of gas pipeline,

…In an Oct. 20 letter, the EPA maintained it always had serious concerns about the project, and recommends the approximately 515-mile-long pipeline’s path be redrawn to avoid environmentally sensitive areas in Florida.

Now, the WWALS Watershed Coalition environmental group has filed to get the letter admitted as evidenm in a legal challenge to prevent the Florida Department of Environmental Protection from issuing a permit for the project, said WWALS president John Quarterman.

“It validates everything we’ve been saying,” he said.

Here is that EPA letter to FERC.

Last month, WWALS and Tallahassee attorneys representing Sabal Trail met face-to-face at Continue reading

Floridians please call your state rep against fracking bill

WWALS is a member of Floridians Against Fracking, which recommends today for Florida citizens to call their state legislator:

The pro-fracking regulatory bill is up in committee already! The Agriculture and Natural Resources Subcommittee will hear House Bill 191l on Tuesday, 11/03/15, at 12:00 pm, in Reed Hall (102 House Office Building). We NEED to call them the day before the meeting so that they go in with our concerns on their mind.

Recall that these bills take away the opportunity for cities and counties to ban fracking locally. They are also contrived transparency—they are only supported by the oil and gas industry and their buddies. They fail to protect the citizens of Florida and our water and natural resources.

You can make calls to the legislators below to tell them to vote NO on House Bill 191: (Listed in order of priority for calls—if you hve time for one, call the top one, if you have time for 2, call the top two, etc.)

WWALS moves to enter EPA letter to FERC into evidence in Florida case

Everyone from the Atlanta Journal-Constition to the Palm Beach Post to the Ocala StarBanner Comes now, Petitioner... and moves.... considers the EPA letter to FERC to be of great significance. WWALS agrees, and has filed a motion to ask the judge to take notice in WWALS v. Sabal Trail & DEP.

§ 373.414 Florida Statutes, begins:

(1) As part of an applicant’s demonstration that an activity regulated under this part will not be harmful to the water resources or will not be inconsistent with the overall objectives of the district, the governing board or the department shall require the applicant to provide reasonable assurance that state water quality standards applicable to waters as defined in s. 403.031(13) will not be violated and reasonable assurance that such activity in, on, or over surface waters or wetlands, as delineated in s. 373.421(1), is not contrary to the public interest. However, if such an activity significantly degrades or is within an Outstanding Florida Water, as provided by department rule, the applicant must provide reasonable assurance that the proposed activity will be clearly in the public interest.

Not just “not contrary to the public interest”. For an Outstanding Florida Water applicant (Sabal Trail) “must provide reasonable assurance that the proposed activity will be clearly in the public interest.” The Suwannee River is an Outstanding Florida Water. And the EPA letter is pretty good evidence that Sabal Trail did not provide such reasonable assurance.

Videos: More WWALS witnesses, rebuttal, Spectra speaks, and WWALS counsel summation in Day 3, WWALS v. Sabal Trail & FDEP 2015-10-21

Willard Randall, expert welder Sabal Trail didn’t want to hear that Sierra Club is funding part of WWALS’ legal expenses and they really didn’t want to hear about Spectra’s speckled history of safety and compliance. The Respondents also didn’t expect the WWALS pipeline welder expert witness in this third and last day of the final hearing.

DEP tried to argue their own key applicant process substance person couldn’t qualify as an expert witness for WWALS. A sitting Suwannee County Commissioner testified. A fireman who lives near the proposed compressor station said a few words about Sabal Trail saying one thing and doing another. A string of WWALS witnesses talked about generations of use and enjoyment, joining WWALS because WWALS took in the upper Suwannee as territory, more new WWALS members, WWALS as a Waterkeeper® Alliance Affiliate.

The Respondents rebuttal witnesses were Continue reading

Videos: WWALS witnesses in Day 2, WWALS v. Sabal Trail & FDEP 2015-10-20

Dennis Price cross-examination DEP’s only witness yesterday, today also a witness for WWALS, couldn’t find a document she needed in the Respondents’ cartload (literally) of documents, not even with the help of five Respondent attorneys, yet everyone could find items in the two WWALS exhibit books quite readily.

We also learned that concerns were irrelevant, only actual effects on WWALS members count, which made it too difficult for Merrillee Malwitz-Jipson to get qualified as an expert witness, even though she has assisted DEP and SRWMD in environmental issues. And we couldn’t talk about air quality issues, since DEP already issued an air quality permit for the Sabal Trail Hildreth compressor station in Suwannee County, so what David Shields could talk about was very limited, even though he and his family with their organic farm live downwind of that compressor station. However, WWALS expert witness Dennis Price hit geological questions out of the ballpark. And a cow did fall into a sinkhole.

Here are WWALS videos of each witness, followed by a video playlist. See also much more about this case, including videos of the other two days, and how you can help WWALS defend our members, the Suwannee River, and the Floridan Aquifer.

Come to the hearing, WWALS v. Sabal Trail & FL-DEP, Jasper, FL 2015-10-19

We aim to win through evidence and argument! If we can stop either the Environmental Resource Permit (ERP) or the Easement to Use Sovereign Submerged Lands (Easement) that the Florida Department of Environmental Resources (DEP) intends to issue for Sabal Trail, there may be no pipeline.

Witnesses can still come forward to testify for the Suwannee or other Rivers, the Florida Aquifer, or their own land, water, and air against Sabal Trail. WWALS invites the public to attend; This is a court of law, so please be polite, and silent while proceedings are in progress.

Here’s some background on the case. Below is Judge Canter’s order of this morning about place, date, and time (PDF): Continue reading

Three FERC Sabal Trail meetings in WWALS territory: Moultrie, Valdosta, Lake City, Sept. 29,30, Oct 1 2015

After Albany on Monday, the Moultrie, Valdosta, and Lake City FERC Sabal Trail hearings are all in WWALS territory, and Sabal Trail’s fracked methane pipeline would cross WWALS’ Okapilco Creek near Moultrie, Withlacoochee River near Valdosta, and Suwannee River near Jasper. The Georgia DNR board Wednesday gave away easements under those streams to Sabal Trail, but they’re not permanent until at least two more state approval steps, and they mean nothing if the pipeline is cancelled.

The FERC meetings are all 5:30 PM speaker signup, 6 PM FERC presentation, then 3 minutes each per audience speaker, ending 8 PM.

  • Monday, September 28, 2015, at Albany Civic Center, Meeting Room, West Oglethorpe, Albany, GA 31701
  • * Tuesday, September 29, 2015, at Colquitt County High School, Withers Auditorium, 1800 Park Avenue SE, Moultrie, GA 31776
  • * Wednesday, September 30, at Holiday Inn Valdosta, Conference Center Magnolia Ballroom, 1805 West Hill Ave., Valdosta, GA 31601.
  • * Thursday, October 1, at Columbia High School Auditorium, 469 SE Fighting Tiger Drive, Lake City, FL 32025

* Marks meetings in WWALS territory.

Why is the first Florida meeting in Lake City, when Sabal Trail does not propose to go through Columbia County? Continue reading

Sabal Trail exposed in Jasper News

The closest FERC meeting is actually in Valdosta, Lowndes County, Georgia, 30 September 2015. And remember, sinkholes don’t matter, says FERC.

Front page Amber Vann, Jasper News, 24 September 2015, Federal Energy Regulatory Commission: Sabal’s proposed pipeline impact ‘less than significant’ on environment,

According to the EIS, “constructing and operating the Sabal Trail Project in South Georgia/North Florida could induce sinkhole development, alter spring characteristics and impact local groundwater flow and quality.” However, the study finds that Sabal Trail’s proposed impact minimization measures and construction methods would cause the project to not “significantly impact karst terrain, springs or the Floridian aquifer.”

The EIS goes on to state the Floridian aquifer is the “most productive aquifer Continue reading

Notice of Hearing in Jasper, FL October 19-22 2015 for WWALS v. Sabal Trail & FL-DEP

WWALS will argue for conserving the Suwannee River, the Floridan Aquifer, and other wetlands of Florida against the Sabal Trail fracked methane pipeline at this hearing in Jasper (or Live Oak). WWALS asked for Jasper in November because that’s in the middle of the affected landowners, while Sabal Trail and FL-DEP asked for Tallahassee in October because that’s where their offices are; it looks like the judge split the difference.

If you want to be a witness for WWALS, please contact us ASAP; time is very short. If you want to help financially, you can contribute to the IndieGoGo crowdfunding campaign. Or become a member of WWALS.
