Videos: Quarterman Road rezoning unanimously denied @ LCC 2023-09-12

Update 2023-09-26: Curious omissions from the minutes; see Packet: Golf carts, mental health, wetland credits, regional transit, Lift Station and Fire Station Access Roads, 2 TIA Road Bids @ LCC 2023-09-25.

The Lowndes County Commission unanimously denied the inappropriate 2.5-acre rezoning proposed on minimum 5-acre and predominantly agriculture, forestry, and conservation Quarterman Road, after five local residents spoke against and nobody for.

Thanks to all who signed the petition against that rexoning, who called or wrote County Commissioners, who spoke in the Planning Commission or County Commission meetings, and thanks to the County Commisisoners for denying the rezoning.

Among the five who spoke at the County Commission were Gretchen Quarterman (who also took the videos for Lowndes Area Knowledge Exchange (LAKE)) and Suwannee Riverkeeper John S. Quarterman (details on both are below). He made sure the Commissioners had a copy of the WWALS letter that had mysteriously been left out of the board packet; thanks to WWALS President Sara Jay Jones for signing that letter.

This denial comes after two previous denials, both also in an Agriculture/Forestry/Conservation Character Area, both also provoking many petition signatures and speakers in opposition, including WWALS.

Maybe developers will get the picture that development is not appropriate in such a Character Area, especially when wetlands and waterways are affected.

County Planner

It is interesting the extent to which a development mindset can color a presentation by a County Planner. I was just going to mention one example of that, but as I listened to the LAKE video of his presentation, I kept noticing more examples. Continue reading

Dollar General developer and property owner sue Lowndes County about rezoning denial –VDT 2023-05-03

The plaintiffs’ case is based on the Lowndes County Commission not agreeing with county staff’s recommendation to approve the rezoning, as well as “evidence supporting their petition and codes relating to the Unified Development Land Code.”

Maybe this is the “enhanced facade” that Dollar General offered in the Public Hearing after which the County Commission denied the rezoning, on January 1, 2023.

Also the plaintiffs say all the public comments were “generalized and speculative”. Huh, I sure thought I heard a bunch of quite specific public comments. The letter WWALS sent to the Commission before that Public Hearing was quite specific, for example, in saying the allegation that the closest effect on nearby property owners would be on their residences was hogwash, given that stormwater from the subject site runs west under GA 122 onto neighboring property much closer than that residence.

There was speculation in various comments, but it was based on easily documented history of Dollar General and of property development in Lowndes County.

After a story by a Valdosta Daily Times reporter, that local organ of record weighed in with an editorial supporting the citizens. Continue reading

Lowndes County nixes planned Dollar General –VDT 2023-01-26

Update 2023-05-06: Dollar General developer and property owner sue Lowndes County about rezoning denial –VDT 2023-05-03.

Thank you, Lowndes County Commission, and all the opposition speakers and writers, for this win written up in the local newspaper of record.

This win keeps some trash out of the Withlacoochee River, upstream from Valdosta and Florida, while stopping a foothold for further development too close to the river, avoiding clearcutting, impervious surface, and the flooding that would have caused.

Teramore Development, the retail real estate company behind the request, petitioned to rezone three acres of the 35-acre property from Estate Agricultural to Crossroads Commercial.

Sprawl in an aquifer recharge zone back on the Lowndes County Commission agenda 2022-02-08

The same proposed rezoning in Lowndes County that WWALS E.D. Gretchen Quarterman spoke against in November will be back on the Lowndes County Commission agenda for a decision at 5:30 PM February 8, 2022.

That’s 5:30 PM, Tuesday, February 8, 2022, on the second floor at 327 North Ashley Street, Valdosta, GA 31601.

Remember, this is upstream on the Little River from Florida and Brooks County Georgia, as well as Lowndes County. Because it’s a rezoning, anybody from anywhere can speak during the public hearing at that meeting. However, they will only allow a few people to speak for a few minutes.

So even better would be to send a written objection before the meeting to commissioner@lowndescounty.com. You can also try emailing the Commissioners individually, https://lowndescounty.com/directory.aspx?did=19 Beware that some of the Commissioners do not read their county email addresses, so best to also copy the County Clerk, belinda@lowndescounty.com.

Gretchen spoke against the new version of this rezoning (bigger lots) again Monday at the Greater Lowndes Planning Commission, this time pointing out that when community wells fail, their owners hand them over to the county, which puts the taxpayers on the hook for fixing them, so we don’t need any more community wells. A room full of opponents raised their hands at that meeting, and more than 300 signed a petition against the rezoning.

The subject property is also near some notorious sinkholes, the Myers Bluff Sinkhole on the Little River, and the Shiloh Road Sinkhole that fortunately did not take down that road or a nearby house. The Snake Nation Road Sinkhole, a bit farther south, forced the county to reroute that road to the tune of about half a million dollars. Continue reading

Withdrawn but will return: subdivision in aquifer recharge zone near Little River, Lowndes County, GA @ LCC 2021-12-14

Update 2022-02-02: Sprawl in an aquifer recharge zone back on the Lowndes County Commission agenda 2022-02-08.

Update 2022-01-09: Cancelled: Lowndes County Commission Meetings 2022-01-10, so expect expect the contentious Miller Bridge Road subdivision that was withdrawn last time to be back with larger lot sizes at the January 24 and 25 Commission meetings.

The subdivision WWALS E.D. Gretchen Quarterman spoke against at the November Planning Commission meeting was withdrawn before the December Lowndes County Commission meeting.

But the withdrawal letter said they would be back with a new plan by January 5th. The subject property near the Little River is still in an aquifer recharge zone, and far outside any appropriate Character Area in the Comprehensive Plan. Continue reading

Update 2022-01-02: Withdrawn but will return: subdivision in aquifer recharge zone near Little River, Lowndes County, GA @ LCC 2021-12-14

When the Greater Lowndes Planning Commission (GLPC) held a Public Hearing Monday for a rezoning for a subdivision in an aquifer recharge zone, WWALS Executive Director Gretchen Quarterman spoke against it. Three hundred other people opposed the rezoning. The Planning Commission unanimously voted to recommend denying it.

But GLPC does not decide: the Lowndes County Commission will do that on December 14, 2021. And the County Commissioners can, if they choose, change the lot size or approve the rezoning as proposed.

This is what to watch for on that upcoming agenda: REZ-2021-28 Windy Hill S/D, 7532 Miller Bridge Rd., 0010 022, 34 ac., Community well & septic, EA to R1.

Valdosta passes resolution opposing strip mine near Okefenokee Swamp 2021-11-11

Update 2023-01-05: News again: Valdosta’s 2021 resolution against the strip mine proposed too near the Okefenokee Swamp 2023-01-01.

Yesterday the most populous city in the Suwannee River Basin passed a resolution opposing the proposed Twin Pines Minerals (TPM) strip mine or any others within ten miles of the Okefenokee Swamp. The resolution further asks the U.S. Army Corps of Engineers to reverse its abdication of oversight, asks GA-EPD for a moratorium on all mining permits until effects are settled of the recent court overruling of 2020 Clean Water Act changes, as well as to reject the TPM permits, or at least to review those applications as thoroughly as the Army Corps would, and asks the Georgia legislature to prevent such strip mines near the Swamp or any blackwater rivers in the Suwannee River Basin.

Dear Planner Martin,

WWALS Watershed Coalition, Inc. asks the Valdosta Mayor and Council to deny deannexation of half of the Cherry Creek Mitigation Bank (CCMB) in VA-2021-16 at its meeting this Thursday, August 5, 2021. As you know, the Greater Lowndes Planning Commission (GLPC) already voted 6-3 to recommend against deannexation.

Given the lack of any good reasons by the applicant for deannexation of that 310 acres of Withlacoochee River floodplain around Cherry Creek, let me remind everyone of some reasons not to deannex.

The CCMB is directly across the Withlacoochee River from Shadrick Sink. Valdosta already had to sink its water wells on Guest Road twice as deep because of river water going into Shadrick Sink, then through ground water several miles east to those wells. The choice was to pay for much more expensive methods to deal with tannic acid and biological components of the river water, or dig the wells deeper. Withlacoochee River floodplain deannexation at Valdosta City Council 2021-08-05

Update 2021-08-05: WWALS to Valdosta: please deny deannexation of Cherry Creek Mitigation Bank 2021-08-05.

Thursday evening the Valdosta City Council decides whether to deannex 310 acres of Withlacoochee River floodplain around Cherry Creek, uphill from the Withlacoochee River.

The Greater Lowndes Planning Commission voted 6-3 to recommend denial, apparently deciding no good reason for deannexation was given by the applicant. There are substantial reasons to be concerned about potential uses of that land if deannexed.

Instead, Valdosta and Lowndes County should purchase the entire 530.24 acre property down to the Withlacoochee River to add to a trails system up along the Withlacoochee River, connecting with the Withlacoochee and Little River Water Trail all the way down to the future Troupville River Camp.

Valdosta should not deannex 310 acres of Withlacoochee River floodplain around Cherry Creek. No good reason for deannexation has been given by the applicant, and there are substantial reasons to be concerned about potential uses of that land if deannexed. Instead, Valdosta and Lowndes County should purchase the entire 530.24 acre property down to the Withlacoochee River to add to a trails system up and down the Withlacoochee River. The advisory Greater Lowndes Planning Commission (GLPC) at its meeting this Monday should recommend against annexation, and then the Valdosta Mayor and Council should deny.

That deannexation is on the GLPC agenda for this Monday, July 26, 2021. The only land access to the property is through the City of Valdosta, and since that whole area of the river has extensive flood plain and little road access, Lowndes County cannot provide public utilities, fire/police protection, or emergency medical response across the river to the subject property, as the City Planner points out in the agenda sheet. The landowner’s stated purpose would be better served by the property remaining inside the city limits: “to use for wildlife management, and rec. use as it is in a mitgation bank & has no development use.” The City Planner even recommends annexing the rest of the subject property into the city, down to the river.
