SRWMD listens about Sabal Trail easements, chooses unfortunately, yet offers assistance 2016-07-12

Attached are my comments to the SRWMD Governing Board today (July 12th 2016) in regards to the Sabal Trail crossing site over the Falmouth Cathedral Cave System.

I was the first to speak at the public comment period followed by Jim Tatum then Merrillee. Jim and Merrillee echoed my concerns. The three of us set the tone for the meeting! The Board was interested and engaged asking questions to better understand what impacts Sabal Trail poses for the cave system and the District. About Time!

New hydrology report exposes Sabal Trail pipeline risk to Floridan Aquifer

FOR IMMEDIATE RELEASE

Jasper, Florida, July 1st 2016 — Another independent professional geologist reveals more omissions and discrepancies in pipeline company reports and faults in federal oversight of the Sabal Trail pipeline: Figure 7: Locations of the caves and springs mentioned in this study groundflow actually goes the other way, drilling under a river will change water flow in the Floridan Aquifer, and there is very high risk of sinkhole collapse. An indigenous Floridian commissioned this scientific report to protect his mother, the living earth. This geological report provides compelling additional reasons for the U.S. Army Corps of Engineers (USACE) to open a new process to evaluate this and other new information.

Bobby C. Billie, one of the Clan Leaders and Spiritual Leader, Council of the Original Miccosukee Simanolee Nation Aboriginal Peoples, asked professional geologist and hydrologist Peter Schreuder, P.G. to conduct investigations at the proposed Sabal Trail crossing under the Suwannee River from Hamilton County and under U.S. 90 in close proximity to the Falmouth Cave System in Suwannee County.

Push to block Sabal Trail gas pipeline looks to enlist U.S. Army Corps of Engineers –Florida Bulldog

Again tying Florida Governor Rick Scott into the Sabal Trail fracked methane pipeline invasion, Florida Bulldog reports about last month’s elected official hike at the Suwannee River, Pastured Life, Peurrung, Hildreth Compressor Station but could get no response from hike attendee Ted Yoho FL-03. And FL Bulldog confirmed that as of last week the Corps had not responded to Sanford Bishop GA-02.

WWALS asks Lowndes County to do three things more against Sabal Trail 2016-04-24

Sent yesterday to the Chairman, the other five elected Lowndes County Commissioners, and the County Clerk (PDF). They meet again 5:30PM Tuesday evening, April 25th 2016.

Dear Commissioners,

Thanks to Chairman Bill Slaughter for saying in the Valdosta Daily Times that the Commission signing an easement contract was not an endorsement of the Sabal Trail pipeline.[1] Therefore I ask you to:

  1. Invite the U.S. Army Corps of Engineers to investigate on site and on paper the numerous omissions by Sabal Trail of springs and underground water transmissivity in what it told the Federal Energy Regulatory Commission; .please see the letter from WWALS to the Army Corps,[2] attached with the letter from WWALS to you of April 12th.
  2. Ask our U.S. Congress member Austin Scott (GA-08) to join the four Georgia Congress members who have already asked FERC to fix its processes or deny a permit for Sabal Trail.[3]
  3. Join the hundreds of organizations and thousands of individuals who have already asked the U.S. Congress to call in the General Accounting Office (GAO) to review FERC’s permitting processes.[4]

Please find appended further information about the issues the Chairman raised in the VDT of eminent domain, in differences in regulation of oil and gas pipelines, and in environmental and safety issues of natural gas pipelines.

Since I wrote to you on April 12th, two more major natural gas pipelines have run into serious problems.

In today’s Sunday April 10th 2016 Valdosta Daily Times:

The Georgia House on March 22nd by an unprecedented 34 ayes to 128 nays rejected easements for Sabal Trail Sunday VDT to drill our Withlacoochee and other Georgia Rivers. This was a historic victory by the Georgia Water Coalition, including Georgia Sierra Club, WWALS, Flint Riverkeeper, Chattahoochee Riverkeeper, plus SpectraBusters, and thanks to all of you who called their state reps.

Reject Sabal Trail easement payment tonight –WWALS to Lowndes County Commission 2016-01-26

The Lowndes County Commission is voting tonight on an easement for the Sabal Trail fracked methane pipeline through a mercury-contaminated closed landfill. STA. 12818+00 TO STA. 12871+00, Clyatt Mill Creek, Railroad Ave. They only gave one day’s notice, and they didn’t mention the landfill. Here is the letter (PDF) I just sent them asking them to reject that easement, to support their own previous unanimous resolution against Sabal Trail, and to contact state and federal elected and appointed officials and ask them also to reject Sabal Trail. Videos: More WWALS witnesses, rebuttal, Spectra speaks, and WWALS counsel summation in Day 3, WWALS v. Sabal Trail & FDEP 2015-10-21

Willard Randall, expert welder Sabal Trail didn’t want to hear that Sierra Club is funding part of WWALS’ legal expenses and they really didn’t want to hear about Spectra’s speckled history of safety and compliance. The Respondents also didn’t expect the WWALS pipeline welder expert witness in this third and last day of the final hearing.

DEP tried to argue their own key applicant process substance person couldn’t qualify as an expert witness for WWALS. A sitting Suwannee County Commissioner testified. A fireman who lives near the proposed compressor station said a few words about Sabal Trail saying one thing and doing another. A string of WWALS witnesses talked about generations of use and enjoyment, joining WWALS because WWALS took in the upper Suwannee as territory, more new WWALS members, WWALS as a Waterkeeper® Alliance Affiliate.

Videos: WWALS witnesses in Day 2, WWALS v. Sabal Trail & FDEP 2015-10-20

Dennis Price cross-examination DEP’s only witness yesterday, today also a witness for WWALS, couldn’t find a document she needed in the Respondents’ cartload (literally) of documents, not even with the help of five Respondent attorneys, yet everyone could find items in the two WWALS exhibit books quite readily.

We also learned that concerns were irrelevant, only actual effects on WWALS members count, which made it too difficult for Merrillee Malwitz-Jipson to get qualified as an expert witness, even though she has assisted DEP and SRWMD in environmental issues. And we couldn’t talk about air quality issues, since DEP already issued an air quality permit for the Sabal Trail Hildreth compressor station in Suwannee County, so what David Shields could talk about was very limited, even though he and his family with their organic farm live downwind of that compressor station. However, WWALS expert witness Dennis Price hit geological questions out of the ballpark. And a cow did fall into a sinkhole.

GA-DNR should not give away easements to Sabal Trail –FrK, WWALS, GA Sierra Club

In addition, J. Mark Mobley, Jr. of Moultrie, Colquitt County, GA, is Vice Chair of the Land Committee that meets first. LTE If that Committee doesn’t recommend the Sabal Trail give-away, the full DNR board probably won’t vote on it. You can send the GA-DNR board members comments, or go to the meeting Wednesday morning 9AM in Atlanta. Meanwhile, this LTE (PDF) just went to the Albany Herald.

Sabal Trail Pipeline needs easements granted by the DNR Board to pass under key southwest and south-central Georgia rivers and creeks. Elsewhere in Georgia, over to the east and on the coast, Governor Deal’s DOT recently blocked the use of eminent domain for a gas and diesel pipeline.
