WWALS first President Dave Hetzel 1936-2022

Dave Hetzel will be missed. He was the first President of WWALS, a longtime board member and WWALS Ambassador (a Vice President), promoter of solar power, opponent of pipelines, a fixture at festivals for WWALS from Cedar Key, Florida to Alapaha, Georgia, loved to paddle on our rivers and to promote the Alapaha River Water Trail and the BIG Little River Paddle Race; friend to all.

Also, Dave was a good sport. On his very first paddle outing with WWALS, he got dunked completely underwater in the Alapaha River, but he popped right up and never complained.

Fossil fuel forever bills in Georgia and Florida legislatures

Do these bills sound just as bad? You can help stop them, including in a committee meeting this morning.

A BILL to be entitled an Act to amend Title 46 of the Official Code of Georgia Annotated, relating to public utilities and public transportation, so as to prohibit governmental entities from adopting any policy that prohibits the connection or reconnection of any utility service based upon the type or source of energy or fuel; to provide for related matters; to provide for an effective date; to repeal conflicting laws; and for other purposes. —GA SB 102

Mirrored across the GA-FL line:

Preemption on Restriction of Utility Services; Prohibiting municipalities, counties, special districts, or other political subdivisions from enacting or enforcing provisions or taking actions that restrict or prohibit the types or fuel sources of energy production which may be used, delivered, converted, or supplied to customers by specified entities; providing for preemption; providing for retroactive application, etc. —FL SB 1128

The words have been stirred, but the bills are essentially the same. Except the Florida bill goes for full unconstitutional ex post facto law with “providing for retroactive application”.

This stuff stinks of ALEC, the American Legislative Exchange, the private shadow government in which industry representatives and state legislators vote together on model bills that the state reps take back and try to pass. If they succeed, they become ALEC alumnae. ALEC or not, they’re bad bills that should not pass.

GA SB 102 has already been voted out of committee in the Georgia Senate, and its equivalent already passed the Georgia House.

FL SB 1128 is scheduled this morning at 9AM, March 16, 2021, for its second committee, Community Affairs, 03/16/21, 9:00 am, 37 Senate Building.

The Florida bills seems to have inadvertently missed listing Liquified Natural Gas (LNG), possibly because their authors thought “petroleum products” covered that (it doesn’t). Not to worry: “but is not limited to.”

Also, this is not just about directly passing an ordinance against fossil fuels, which most local governments already knew wouldn’t work. SB 856 would create Florida Statutes Section 377.707, with (1)(b):

FPL and JEA exiting Plant Scherer Unit 4 near Macon, GA 2020-06-26

The biggest, dirtiest, coal plant in the country is losing the owners of one of its four units: Plant Scherer, near Juliette, Georgia, north of Macon. Florida Power & Light (FPL) and the Jacksonville Electric Authority (JEA), are bailing out of their 76.4% and 23.6% shares of unit 4, by January 2022. Somebody else may buy into unit 4, and thus Georgia Power may keep it running. But maybe not, considering the reason for FPL and JEA exiting is that the plant is no longer economical to run. Meanwhile, where will the coal ash go?

At least maybe soon less mercury will go into the air and come down in the Withlacoochee and Alapaha Rivers and the Okefenokee Swamp.

Unit 4 uses coal to produce JEA’s 200 MW portion of electricity output, which is delivered to Jacksonville over large, high-voltage electric transmission lines.

This move was signaled in FPL’s Ten Year Power Plant Site Plan 2020 – 2029, Submitted To: Florida Public Service Commission, April 2020:

(i) Retirement of Existing Generating Units That Are No Longer Economic to Operate:

…the retirement of FPL’s ownership portion (approximately 76%) of the coal-fueled Scherer Unit 4 unit in Georgia is planned by January 2022. FPL’s ownership portion of this unit is approximately 630 MW.

Statement on Environmental Justice

Suwannee Riverkeeper and WWALS Watershed Coalition, Inc. protect the Suwannee River Basin for the sake of every person who visits or lives here. Clean water is essential to everyone, regardless of their ethnicity, beliefs, politics, or anything else. However, during the course of our work opposing the Sabal Trail methane pipeline and other advocacy, it became clear that minorities and economically disadvantaged people will disproportionately experience negative effects. We continue to work against such environmental injustice across the entire Suwannee River Basin in dozens of counties in Georgia and Florida. Valuing all the watershed’s inhabitants is entirely compatible with having added concern for those facing added danger.

The killing of George Floyd and many other recent tragedies suffered by people of color show that even if we strive to love our neighbors equally, the threats and injustices they face are not equal. As professionals and volunteers we fight for the human right of clean water. As Dr. Martin Luther King Jr. wrote from a Birmingham jail, “Injustice anywhere is a threat to justice everywhere. We are caught in an inescapable network of mutuality, tied in a single garment of destiny. Whatever affects one directly, affects all indirectly.” It appears to us that the economic forces that drive unnecessary pipelines under rivers and through disadvantaged neighborhoods and that have made it so difficult to oppose pipelines and mines are the same forces that have resulted in so many recent tragedies with little justice. We have always stood for nonviolent advocacy, but we cannot condemn the few who have used other means without also pointing to the large corporations that benefit from subsidies, tax breaks, and legal advantages while so many get nothing.

We seek to listen and learn from our colleagues and neighbors. We do not pretend to be experts on racial issues. Nevertheless, we promote clean water to ensure healthy communities, and we are concerned about all members of those communities: especially the most vulnerable. We stand against racism and injustice in any form.

As one small step, we plan to offer swimming and boating lessons especially to minorities and economically disadvantaged people; please contact us about that.

Meanwhile, an election is in progress. Please look at what each candidate says about environmental issues. If a candidate will not stand up to protect rivers and swamps, you may want to look more closely at their promises about people.

Sabal Trail still below gas capacity 2020-04-26

Almost two years after starting to push gas, Sabal Trail still isn’t using all it’s already authorized for, so why does it need Phase II? Why are we still wasting money, water, and air on pipelines when solar panels long ago could have provided more electricity, faster, cheaper, and with no emissions and no eminent domain?

If the point of the Phase II Albany, GA, and Dunnellon, FL, Compressor Stations is to pipe more gas to the Reunion Compressor Station, somebody should tell Sabal Trail the Mouse is closed due to pandemic.

Industry press: WWALS and Sierra Club oppose FERC rubberstamp of Sabal Trail compressor stations 2020-04-23

Sabal Trail is no exception to widespread pipeline opposition, notes a prominent fossil fuel industry publication, especially for the recent decision by the Federal Energy Regulatory Commission (FERC) to authorize operation of Sabal Trail’s Phase II Albany, GA, compressor station during a virus pandemic. Neither Platts nor the AJC noted the Dunnellon, FL, compressor station was also authorized in Phase II, even though that site already leaked before station construction started.

Maya Weber, Joe Fisher ed., S&P Global Platts, 2020-04-23, Sabal Trail gets FERC OK to start compression, over green group objections.

The article first rehearses Sabal Trail’s request for a six-month extension and about-face request for immediate operations, which FERC rubberstamped. You can read about that in more detail in the previous WWALS blog post. That post also has details of the WWALS and Sierra Club objections that the Platts article then notes.

Urging denial

Sierra Club and WWALS Watershed Coalition in recent weeks urged FERC to deny the request in separate filings.

“The Albany compressor station would increase air pollution—which has been linked to higher coronavirus death rates—in a predominantly African American community that has ‘one of the highest infection rates in the country,'” wrote Sierra Club attorney Elly Benson in an April 13 letter to FERC, citing news articles. “Now is not the time to needlessly increase the pollution burden on an environmental justice community that is particularly vulnerable to these threats.” She said 84% of residents within a half-mile radius of the Albany facility are African American.

On Earth Day, FERC approved Sabal Trail Albany, GA, and Dunnellon, FL, compressor stations 2020-04-22

FERC on Earth Day rubberstamped Sabal Trail pipeline compressor stations in Georgia virus hotspot and Florida location that already leaked

Hahira, Georgia, April 23, 2020 — “What better way to say they don’t care, than to do this on Earth Day?” said Suwannee Riverkeeper John S. Quarterman, “The Federal Energy Regulatory Commission (FERC) broke out its rubberstamp during a virus pandemic, ignoring its own process, as well as all the comments and our motion against, to approve turning on two compressor stations, including one in Albany, Georgia, which is the Georgia city worst-affected by the virus, and another at a site near Dunnellon, Florida, which already leaked multiple times even before construction started.”

Methane from fracking is not more important to push through a Sabal Trail pipeline than the health of local people or even Sabal Trail’s own workers.

Quarterman added, “With the price of oil negative and “natural” gas down 40%, it’s time to ask investors if they want to go down with the fossil fuel ship of fools and time to ask politicians if they want this to be their legacy.”

Only four weeks before the FERC approval letter, FERC opened a comment period on a request by Sabal Trail for six more months to finish these same facilities, in which Sabal Trail cited the virus pandemic as a reason. Contradicting its own request, and during that two-week period, Sabal Trail asked FERC to go ahead and approve turning on both compressor stations, which must involve Sabal Trail workers working during pandemic conditions.

FERC did not even mention that WWALS Watershed Coalition (WWALS) had moved to deny, nor any of the numerous other comments against turning on the compressor stations.

For that comment period, FERC required organizations to file again to be Intervenors, and only organizations that were already Intervenors on the process of the underlying FERC docket could do that. The only one to do that was Suwannee Riverkeeper for WWALS (see PDF). WWALS also filed a motion to halt Sabal Trail’s Phase II (which is mostly these two compressor stations), to deny Sabal Trail’s request to turn the compressor stations on, and to invoke penalties for already being two years late (see PDF). WWALS reasons to deny included repeated previous leaks at the Dunnellon Compressor Station of hazardous Mercaptan odorant, as well as leaks of methane at the Hildreth Compressor Station in Suwannee County, Florida, plus sinkholes at the Flint River near the Albany Compressor Station, the virus pandemic, and Sabal Trail gas going to private profit through Liquid Natural Gas (LNG) export, making a mockery of local landowners having to give up easements through federal eminent domain supposedly for the public good of the United States.

WWALS also noted that the only “justification” for Sabal Trail was alleged “market need,” and there was none any more, since oil and gas prices had dropped through the floor. Since then, oil prices actually went negative for the first time in history, and natural gas prices are down more than 40% from only six months ago.

TECO joins Duke and FPL building solar in Florida 2018-10-29

Solar in Florida is not just for Duke and FPL anymore: Tampa Electric is building 260 megawatt hours of solar power, and the Florida PSC and Office of Public Counsel are praising it for reducing coal and natural gas burning. Even FPSC, which approved the Sabal Trail fracked methane pipeline boondoggle only five years ago, is starting to look up and see the sun in the Sunshine State.

FERC rubberstamps four rehearing denials and a new pipeline on a Friday 2018-08-10

Scurrying to use its rubberstamp before a Commissioner departing leaves it tied 2:2, FERC once again rubberstamped multiple pipelines, this time three on a Friday plus an LNG export project, while neither its main online library nor its backup library yielded copies of the orders.

Glick and LaFleur dissent again from a Spectra pipeline permit 2018-07-19

FERC just rubberstamped three pipelines before Commissioner Robert Powelson exits next month. Yet Commissioners Glick and LaFleur are still complaining every time about lack of use of Social Cost of Carbon to account for Greenhouse Gases (GHG). Those dissents started after Sierra Club won against FERC and Sabal Trail in the DC District Court on just that subject; recently FERC and Sabal Trail declined to appeal to the Supreme Court, thus admitting the pipeline company and its permitter lost that case.

Commissioner Cheryl LaFleur spelled out the connection in her dissent on Spectra’s Texas-Louisiana Markets Project:

I believe the fact pattern presented in this case, a pipeline designed to serve a specific known downstream powerplant, falls squarely within the precedent of Sierra Club v. FERC.1 Given that the majority’s analysis here suffers from the same flaws as its decision on remand in Sabal Trail,2 I respectfully dissent.

Commissioner Richard Glick in his dissent on the same pipeline also explicitly cited Sierra Club v. FERC (Sabal Trail) and went further about the specific underlying laws FERC is shirking:

“Today, the Commission issues a certificate to Texas Eastern Transmission, LP to construct and operate the Texas Industrial Market Expansion Project and the Louisiana Market Expansion Project (Projects), concluding that the Projects are required by the public convenience and necessity.1 The Commission also finds that the Projects will not have a significant effect on the environment.2 In reaching these conclusions, the Commission maintains that it need not consider the harm caused by the Projects’ contribution to climate change. The Commission’s refusal to do so falls well short of our obligations under the Natural Gas Act (NGA)3 and the National Environmental Policy Act (NEPA).4 Because I disagree with these conclusions and believe the Commission cannot find that the Projects are in the public interest without first considering the significance of the Projects’ contribution to climate change,5 I dissent in part from the Commission’s action today.
