If a company from Houston, Texas, gets its rezoning Tuesday at the Adel, Georgia, City Council, it could take trees from 75 miles around to turn into wood pellets to ship to Europe for burning for electricity. It takes 50 to 100 years for natural forest to regenerate completely. Meanwhile, rain on land without forest runs off faster, carries more sediment and pollution (pesticides, E. coli, etc.), damaging fishing and wildlife. Floods also become more likely.

You can help stop this biomass plant. Before 5:30 PM Tuesday, please, which is when the Adel City Council has this rezoning on its agenda.

That 75-mile sourcing radius around Adel would reach Tallahassee, Florida, and Albany, Georgia, as well as all of the Red Hills longleaf area around Thomasville. It would include all the Suwannee River Basin in Georgia: the Suwannee, Alapaha, Little, Withlacoochee, and Okapilco Rivers, from Fargo and most of the Okefenokee Swamp to Cordele in the north and Moultrie, Quitman, and Valdosta. As well as much of the Suwannee River Basin in Florida, include White Springs, Live Oak, Mayo, Jasper, and Madison. Plus the Ochlockonee and Aucilla Rivers and much of the Flint River on the west, and on the east most of the Satilla River and a bend of the Altamaha River.

This is an environmental justice issue because the plant will go in an African-American part of town and poor people are typically most adversely affected by deforestation.

When a local activist alerted me a few months ago to a proposed biomass plant in Adel, I pointed them to Vicki Weeks of the Dogwood Alliance. She has put together an Action Alert. Please follow that link to send your comment to the entire Adel City Council.

Why would Florida toll roads be different? Broke from the start: Texas SH 130 toll road

Why would we expect the Florida M-CORES toll roads would be any different, since they were foisted on the public by a questionable process, just like the Texas SH 130 toll road?

“The original estimates for this job were terribly overstated,” SH 130 Concession Company’s current CEO, Andy Bailey, told KXAN. “The original traffic projections were wildly overstated. The company did a couple of additional traffic projections and still missed.”…

The bankruptcy filing accused SH 130’s management of knowingly paying CTHC for work the company “had not properly completed” and work that “would cause systematic problems” to the highway in the future….

Known cracking and heaving problems not fixed

One of the main elements of the September 2018 bankruptcy filing is accusations that “Ferrovial and Zachry-controlled managers caused the SH 130 Concession Company to pay Central Texas Highway Constructors, known as CTHC, more than $329 million in payments the lawsuit characterizes as ‘fraudulent.’”…

Key words in this story: “fraudulent,” “improperly completed,” “insolvent,” “bankruptcy,” and more.

How can the Suncoast Connector possibly have enough traffic to pay for itself, when, as Tall Timbers points out, “US Highway 19, a four-lane divided roadway, runs throughout the length of the eight-county Suncoast Connector planning area and is substantially underutilized. In fact, for much of its route through the toll road planning area, US 19 functions at between 16 and 20 percent of its maximum service volume.”

SH 130 was touted as traffic relief around Austin for I-35. Actually, it carries mostly truck traffic, and it’s not clear it will ever pay for itself.

What are Suncoast Connector and the other M-CORES toll roads really good for? Nothing but pork for their proponents, as near as I can tell.

A larger Steering Group is meeting weekly to update and resubmit last year’s application for a grant to the Georgia Outdoor Stewardship Program (GOSP) for a Troupville River Camp. This year we have strong buy in from Lowndes County, the City of Valdosta, three local Authorities (Parks & Rec., Tourism, and Development), the Chamber of Commerce, McCall Architects, ASA Engineering, Valdosta Disc Golf, and others. Suwannee River Water Management District has already been participating. The local Georgia statehouse delegation was on last week’s call, as was the Georgia Department of Natural Resources (GA-DNR). Key to all of this is 74 acres for sale by Helen Tapp of Land Between the Rivers (LBTR), below Troupville Boat Ramp down to the Little River Confluence, to be combined with the existing 49-acre VLPRA park, to create a 123-acre Troupville River Park. If you or your organization are interested in helping with this nature preserve and multi-use park, please let us know.

Yesterday we looked to see where hiking, biking, and horse trails might go, to see fishing spots along the Little River, to look at the Little River Confluence, where a Viewscape Pavilion can go.

We considered stairs or ramp for boaters to take out of the Withlacoochee River, to look at invasive plants and native palmettos, big oaks, and pines upstream, along with deadfalls and switchbacks. Then we went inland to see where to put bathrooms, dining pavillion, and sleeping platforms for Troupville River Camp.

We walked up the big discovery by ASA Engineering last November of old Broad Street, the main north-south street and highway of historic Troupville, the Lowndes County seat until 1860, before Valdosta.

To see where the Championship Disc Golf Course could go, we walked down the Power line right of way and the Old Valdosta sewer line near the Withlacoochee River, below the Georgia 133 bridge over the Withlacoochee River.

Later, I went back and established that the apparent East-west road does indeed go through from the Little River to the Crossroads with Broad Street. I didn’t have much luck finding a road through east to the Withlacoochee River, but I did find a Nice hunting spot on the river, more than one Gopher hole, and got pictures of more of the old Valdosta sewer line easement where a Disc Golf fairway can go.

The illusion of pipeline invincibility is shattered –WWALS Brief to FERC in Sabal Trail Rehearing

Let’s cut to the chase in the letter we filed with FERC yesterday:

11. Historic new circumstances add up

The sun never set on the British Empire. Until it did.

No one circumstance ended that Empire, but it is easy to point at major events that accelerated its demise, such as the independence of India and the Suez Incident. Its fall started after the illusion of its invincibility was shattered by Gandhi’s campaign of civil disobedience and other events such as World War II.

The illusion of invincibility of the inland colonial empire of pipelines has been shattered by recent court orders about the ACP, DAPL, and others, and especially by the shut down of the Dakota Access Pipeline and the shuttering of the Constitution Pipeline and the Atlantic Coast Pipeline. All of those pipelines were expected to be built, and DAPL actually was built before being ordered to shut down and empty. Now the world knows that pipelines are not inevitable.

All these pipeline projects, like Sabal Trail, were opposed by nonviolent protests and political and legal actions. All those methods of opposition, combined with the sea-change in progress to renewable energy, eventually added up to a new and significantly different world than that in which Sabal Trail was permitted or re-permitted.

The shut down of DAPL and the abandonment of ACP as well as the court rejection of tolling orders make it a new world even since FERC’s June 19, 2020, Order granting a rehearing on Sierra Club’s motion.

FERC should initiate a new [Supplemental Environmental Impact Statement] EIS that should take into account Sabal Trail’s own track record of leaks and sinkholes, as well as leaks and accidents from [Liquid Natural Gas] LNG export and LNG transport in rail cars, the speeding demise of fossil fuels as evidenced by record low LNG export prices and bankruptcies of frackers, the court rejections of DAPL, ACP, and tolling orders and how much of Sabal Trail could never have been built through environmental justice communities without tolling orders, the coronavirus pandemic, and the rapid rise of renewable solar, wind, and battery power as evidenced by FPL and Sabal Trail partners Duke and NextEra, as well as by FERC’s own numbers. All of those new and significant circumstances make pipelines such as Sabal Trail toxic stranded assets, dangerous to the bank accounts of their investors, as well as to the environment, justice, and human health.

Conclusion

For the reasons stated above, WWALS asks FERC to grant Sierra Club’s motion for stay of the Commission’s letter order of April 22, 2020, to halt Sabal Trail Phase II, and to commence a Supplemental Environmental Impact Statement (SEIS) taking into account all of the above new and significant circumstances.

For those who are not familiar with tolling orders, they are basically how, after the Federal Energy Regulatory Commission (FERC) gives federal eminent domain to a private pipeline company, FERC lets that pipeline company take land before any payment to the landowner or even any agreement is reached. Without tolling orders, it’s not clear the FERC will ever get another pipeline built.

MORE THAN 30 GROUPS ORGANIZE TO SAVE OKEFENOKEE SWAMP

GEORGIA (July 14, 2020) More than 30 national, state, and local organizations have joined forces in the fight to protect the Okefenokee Swamp. The new coalition, known as the Okefenokee Protection Alliance (OPA), recently formed in response to a new and alarming threat to the Okefenokee in the form of proposed heavy mineral sands mining adjacent to the swamp.

In July 2019, Twin Pines Minerals, LLC, submitted a permit application to the U.S. Army Corps of Engineers (Corps) seeking authorization to mine the first phase of what would eventually become a 12,000-acre project abutting the southeast corner of the Okefenokee National Wildlife Refuge.

After the Corps was deluged with letters opposing the project, Twin Pines withdrew that application and submitted a second application to excavate a roughly 900-acre first phase of the mine. The Corps is now weighing whether to approve that second application. Twin Pines must also secure permission from the state of Georgia.

“The new Okefenokee Protection Alliance is the first collaborative effort to have an exclusive focus on the protection of what is arguably our country’s healthiest remaining wetland of significance,” says Christian Hunt, Southeast Program Representative for Defenders of Wildlife. “Everyone came together because of Twin Pines’ permit application, but by design we intend to be active over the long-term and address the present threat that we are dealing with today, as well as future threats that stand to compromise the Okefenokee.”

This week, the Okefenokee Protection Alliance introduced a new website and began urging citizens to write Georgia Governor Brian Kemp, asking him to protect Southeast Georgia’s international natural treasure.

“Just as we have reached out to folks to call on the Corps, we are reaching out to folks to call on Governor Kemp because it is not just the Corps that has a say,” says Rena Peck, Executive Director of the Georgia River Network. “We want Governor Kemp to stand with his constituents and all the citizens in Georgia who are concerned about the mine and ask the Corps for an Environmental Impact Statement.”

The Okefenokee has a long history of support from Georgia leaders. A similar proposal to mine near the Swamp in the 1990s was stopped when Gov. Zell Miller and others spoke out against it; in the 1970s, W.S. “Bill” Stuckey, Jr. who represented the 8th District of Georgia in Congress, successfully fought to designate portions of the swamp as a National Wilderness Area.

Stuckey, now a resident of the Georgia coast, said recently, “I’m hopeful that Governor Kemp will step in to protect the Okefenokee Wilderness and stop the mine.”

OPA member organizations and federal agencies have expressed concerns that the mine could alter the hydrology of the area and impair the movement and storage of water within the swamp, the St. Marys and Suwannee rivers and the Floridan Aquifer.

This could lead to an increased risk of uncontrollable wildfires and impact access to the swamp for boating, fishing, birding, hunting and photography. Pollution from the mining operation could also impact the health of groundwater and surface water.

The Floridan Aquifer, which lies beneath the swamp, is the water source for all of south Georgia and most of Florida, and feeds many springs in the region, which are already adversely affected by overpumping. Thus, anything that affects the swamp or the aquifer could have far-reaching consequences.

“Well, I’m glad they are doing the enforcement order, requiring them to get the fixes in place,” said Deanna Mericle of Hamilton County, Fla., who was among the WWALS members who met with the city of Valdosta back in 2015 about these same sewage issues. “I’m not sure what the $122,000 will be used for, but the fine seems small. I just want the problem fixed for good if possible.”

Three weeks to comment on GA-EPD Valdosta wastewater Consent Order

Hahira, GA, May 4, 2020 — May 27th is the deadline to comment on the Enforcement Order the Georgia Environmental Protection Division (GA-EPD) finally issued on Valdosta for sewage spills. For decades, Valdosta has spilled wastewater into the Withlacoochee River. People downstream, even on the Suwannee River all the way to the Gulf, worry about fishing, swimming, or even boating and some even say their wells are contaminated by fecal bacteria from these spills. Many had hoped that Valdosta’s big spills were over in 2016 with the new Withlacoochee Wastewater Treatment Plant uphill out of the flood plain, plus a Force Main with two Pump Stations. Valdosta says it has spent about $80 million on water system improvements. Yet the spills continued. The Order also reveals a massive fish kill.

“The December 2019 spill was the biggest yet, with no rain, and nothing actually broke. It was a massive failure of supervision,” said Suwannee Riverkeeper John S. Quarterman. “Citizens and elected and appointed officials in Georgia and a dozen counties in Florida demanded something be done.”

This Enforcement Order includes the most popular request, a fine, plus many requirements for management and technology.

One thing it does not include is any requirements for reimbursing downstream well and river testing expenses.

“It’s good to see that the EPD is FINALLY taking this issue seriously!” said Suzy Hall, WWALS Testing Committee Chair. “I can’t help but feel WWALS’ diligence in testing has been a big part of this action, and must continue regardless of any order for the City to conduct testing.”

GA-EPD Enforcement Order for Valdosta wastewater with fine 2020-04-13

Much of what many people requested is in this Enforcement Order EPD-WP-8904 of the Public Notice of April 27, 2020.

Perhaps the most popular request, a fine, is included. As a Project In-Lieu of Penalty (PIP) stream testing is required, three times a week, down to the state line. Plus: “The Respondent shall post all the results of biological monitoring required after major spills to its website and to the Georgia EPD Adopt-A-Stream website within one business day of receipt of the results.”

All 250 sewer line creek crossings must be inspected by drone crews.

Valdosta must notify many Florida agencies, plus in Georgia Lowndes Health and Brooks EMA.

Other things are missing. WWALS is not on that notification list, for example.

And the Order reveals some Valdosta violations the public never knew about, such as a massive fish kill in December 2019. The cost of that calculated by GA-DNR Wildlife Division seems inadequate, since it doesn’t take into account people being unwilling to fish on the Withlacoochee River, for example.

On Earth Day, FERC approved Sabal Trail Albany, GA, and Dunnellon, FL, compressor stations 2020-04-22

FERC on Earth Day rubberstamped Sabal Trail pipeline compressor stations in Georgia virus hotspot and Florida location that already leaked

Hahira, Georgia, April 23, 2020 — “What better way to say they don’t care, than to do this on Earth Day?” said Suwannee Riverkeeper John S. Quarterman, “The Federal Energy Regulatory Commission (FERC) broke out its rubberstamp during a virus pandemic, ignoring its own process, as well as all the comments and our motion against, to approve turning on two compressor stations, including one in Albany, Georgia, which is the Georgia city worst-affected by the virus, and another at a site near Dunnellon, Florida, which already leaked multiple times even before construction started.”

Methane from fracking is not more important to push through a Sabal Trail pipeline than the health of local people or even Sabal Trail’s own workers.

Quarterman added, “With the price of oil negative and “natural” gas down 40%, it’s time to ask investors if they want to go down with the fossil fuel ship of fools and time to ask politicians if they want this to be their legacy.”

Only four weeks before the FERC approval letter, FERC opened a comment period on a request by Sabal Trail for six more months to finish these same facilities, in which Sabal Trail cited the virus pandemic as a reason. Contradicting its own request, and during that two-week period, Sabal Trail asked FERC to go ahead and approve turning on both compressor stations, which must involve Sabal Trail workers working during pandemic conditions.

FERC did not even mention that WWALS Watershed Coalition (WWALS) had moved to deny, nor any of the numerous other comments against turning on the compressor stations.

For that comment period, FERC required organizations to file again to be Intervenors, and only organizations that were already Intervenors on the process of the underlying FERC docket could do that. The only one to do that was Suwannee Riverkeeper for WWALS (see PDF). WWALS also filed a motion to halt Sabal Trail’s Phase II (which is mostly these two compressor stations), to deny Sabal Trail’s request to turn the compressor stations on, and to invoke penalties for already being two years late (see PDF). WWALS reasons to deny included repeated previous leaks at the Dunnellon Compressor Station of hazardous Mercaptan odorant, as well as leaks of methane at the Hildreth Compressor Station in Suwannee County, Florida, plus sinkholes at the Flint River near the Albany Compressor Station, the virus pandemic, and Sabal Trail gas going to private profit through Liquid Natural Gas (LNG) export, making a mockery of local landowners having to give up easements through federal eminent domain supposedly for the public good of the United States.

WWALS also noted that the only “justification” for Sabal Trail was alleged “market need,” and there was none any more, since oil and gas prices had dropped through the floor. Since then, oil prices actually went negative for the first time in history, and natural gas prices are down more than 40% from only six months ago.
