You can help stop the undead Northern Turnpike Extension toll road from plowing over to US 19 and then up it across the Suwannee River.

Floridians, please go to the Florida Department of Transportation’s Northern Turnpike Extension web page and tell FDOT we don’t need any more toll roads. Here’s where you can say No Build:

Late again: Strom Inc. semi-annual report to DoE FE about Crystal River LNG 2021-04-04

Strom, Inc., is late again, like last year when it didn’t file its April report until June 12, 2020.

This does not bode well for Strom’s Crystal River liquid natural gas (LNG) facilities “to commence commercial operations in the fourth quarter of 2022”, as it promised then and again in its October 2020 report, which it filed on October 26, 2020.

You’d think the U.S. Department of Energy (DoE) Office of Fossil Energy (FE) would send Strom a reminder. But as usual, we may have to do it. And we have questions. Continue reading

Waterkeepers Florida Against FDEP Assumption of Army Corps CWA 404 permitting 2020-11-02

Waterkeepers Florida, representing all fourteen Waterkeepers of Florida, wrote to U.S. EPA and FDEP yesterday objecting to FDEP’s plan to take over water permitting from the Army Corps of Engineers. FDEP hasn’t even kept up with the responsibilities it has, and is in no way prepared to take on a much heavier load. Suwannee Riverkeeper voted for this letter, which was also signed by many other organizations, including OSFR and Paddle Florida.

Please vote today for people who will support clean water.

The Florida Department of Environmental Protection (FDEP)’s list of waterways it plans to assume (see FDEP’s Appendix A) omits numerous navigable waterways previously listed by the U.S. Army Corps of Engineers. Checking all the Florida rivers that empty into the Gulf of Mexico, I found that most of them were included by FDEP, except not the Suwannee River or its tributaries (many creeks, Lake Santa Fe, and the Santa Fe, New, Ichetucknee, Alapaha, Alapahoochee, and Withlacoochee (north) Rivers), not the Withlacoochee (south) River nor its tributaries such as the Rainbow River, and not the Ochlockonee River nor its tributaries, such as Lake Talquin. I added 30 Suwannee River Basin waterways and 24 others to the Waterkeepers Florida list of missing waterways, which is the main subject of the Addendum letter (see PDF). The Addendum also contains copies of several letters previously sent to FDEP: an opposition letter similar to the one to EPA, a request for Public Hearings, and a request that online rulemaking hearings be discontinued until the pandemic allows holding them in person.

The illusion of pipeline invincibility is shattered –WWALS Brief to FERC in Sabal Trail Rehearing

Let’s cut to the chase in the letter we filed with FERC yesterday:

11. Historic new circumstances add up

The sun never set on the British Empire. Until it did.

No one circumstance ended that Empire, but it is easy to point at major events that accelerated its demise, such as the independence of India and the Suez Incident. Its fall started after the illusion of its invincibility was shattered by Gandhi’s campaign of civil disobedience and other events such as World War II.

The illusion of invincibility of the inland colonial empire of pipelines has been shattered by recent court orders about the ACP, DAPL, and others, and especially by the shut down of the Dakota Access Pipeline and the shuttering of the Constitution Pipeline and the Atlantic Coast Pipeline. All of those pipelines were expected to be built, and DAPL actually was built before being ordered to shut down and empty. Now the world knows that pipelines are not inevitable.

All these pipeline projects, like Sabal Trail, were opposed by nonviolent protests and political and legal actions. All those methods of opposition, combined with the sea-change in progress to renewable energy, eventually added up to a new and significantly different world than that in which Sabal Trail was permitted or re-permitted.

The shut down of DAPL and the abandonment of ACP as well as the court rejection of tolling orders make it a new world even since FERC’s June 19, 2020, Order granting a rehearing on Sierra Club’s motion.

FERC should initiate a new [Supplemental Environmental Impact Statement] EIS that should take into account Sabal Trail’s own track record of leaks and sinkholes, as well as leaks and accidents from [Liquid Natural Gas] LNG export and LNG transport in rail cars, the speeding demise of fossil fuels as evidenced by record low LNG export prices and bankruptcies of frackers, the court rejections of DAPL, ACP, and tolling orders and how much of Sabal Trail could never have been built through environmental justice communities without tolling orders, the coronavirus pandemic, and the rapid rise of renewable solar, wind, and battery power as evidenced by FPL and Sabal Trail partners Duke and NextEra, as well as by FERC’s own numbers. All of those new and significant circumstances make pipelines such as Sabal Trail toxic stranded assets, dangerous to the bank accounts of their investors, as well as to the environment, justice, and human health.

Conclusion

For the reasons stated above, WWALS asks FERC to grant Sierra Club’s motion for stay of the Commission’s letter order of April 22, 2020, to halt Sabal Trail Phase II, and to commence a Supplemental Environmental Impact Statement (SEIS) taking into account all of the above new and significant circumstances.

For those who are not familiar with tolling orders, they are basically how, after the Federal Energy Regulatory Commission (FERC) gives federal eminent domain to a private pipeline company, FERC lets that pipeline company take land before any payment to the landowner or even any agreement is reached. Without tolling orders, it’s not clear the FERC will ever get another pipeline built.

WWALS Motion to Intervene in Sabal Trail request for Phase II extension 2020-03-30

Yet on March 26, 2020, Sabal Trail asked FERC to extend the May 1st deadline for its Phase II construction of the Dunnellon and Albany Compressor Stations because of the virus pandemic, after FERC already extended way past the original February 2, 2018, deadline for completion of all phases.

FERC surprisingly did not immediately rubberstamp that request, instead opening a comment period until April 13, 2020. WWALS today filed a Motion to Intervene in that comment process on that request.

Marion County Comprehensive Plan to reject Coastal Connector? 2019-01-15

Maybe you’d like to show up 2PM tomorrow, Tuesday, January 15, 2019, and encourage the Marion County, FL, BOCC to adopt into the county’s Comprehensive Plan a Resolution they passed June 5, 2018, which would help head off future road boondoggles. The resolution opposes any Coastal Connector highway routes through Marion County.

As juries recently decided about easement for the Sabal Trail fracked methane pipeline (which Marion County also opposed), “full compensation” is not the same as “just compensation” for road rights of way, either:

J. It must be recognized that the issue is not simply the payment of “full compensation” to owners of the most valuable equine and agricultural properties in Marion County. Rather, it must be recognized that as a result of any of these corridors, the required right-of-way acquisitions and resulting construction of the proposed facility will not only damage, but may destroy many of these important operations in Marion County, and consequently, negatively impact the economic vitality and long-range growth of Marion County; and

Gouging pipelines or highways through farm or horse land or under rivers destroys what they traverse. No amount of compensation would be sufficient.

If you’re nearby, this would be good opportunity to stand up for water, environment, and property rights.

Protesters turned out in St. Pete last year, and now a reporter from Tampa posts an update on double-sad news for Sabal Trail (I’ve added links).

For years, environmentalists warned against constructing the Sabal Trail pipeline. Yet construction wore on, and the controversial natural gas conduit is functional — for now.

The 515-mile pipeline snakes from Alabama to central Florida, and when it’s running, it brings natural gas (mined using the process of fracking) to power plants in the Sunshine State, where it generates energy that power companies sell to customers. The $3.5 billion project is a joint venture between Enbridge, NextEra Energy and Duke Energy Corporation, which make up the group Sabal Trail LLC.

Critical Notice of Sabal Trail Hildreth Compressor outage 2018-01-24

Why are you having an outage at your Hildreth Compressor Station in Suwannee County, Florida, Sabal Trail? And are there continuing stink leaks at your site without a compressor at Dunnellon, Florida in Marion County? Meanwhile, you’re still shipping nothing. For that $3 or $4 billion, much more electricity from solar power could be online right now in Florida, shutting down gas power plants instead of building them.
